the deal

in short: carverjs is operated by MoneyTales EduTech Private Limited. Using the site means you agree to these terms along with the Content Policy and Privacy Policy.

The CarverJS Marketplace (the “platform” or “carverjs”) is operated by MoneyTales EduTech Private Limited, Ahmedabad, Gujarat, India (“we”, “us”, or “our”) at carverjs.dev.

By accessing or using the platform in any way, you enter a binding agreement with us on the terms set out below. If you do not agree, do not use the platform.

These terms incorporate by reference the content policy and the privacy policy. Where those documents are more specific on a topic, they govern that topic.

who can use carverjs

in short: you must be 13 or older. If you are under 18, a parent or guardian must agree to these terms on your behalf.

The platform is open to anyone aged 13 and over. Users between the ages of 13 and 17 may use the platform only with the agreement and active supervision of a parent or legal guardian, who accepts these terms on their behalf and takes responsibility for the minor's activity.

This requirement follows the framework of the Digital Personal Data Protection Act, 2023 (India DPDP Act), which requires verifiable parental consent before processing personal data of minors.

If we discover that an account belongs to a person under 13, we will delete that account and all associated data without notice.

your account

in short: keep your account information accurate, protect your credentials, and know that you are responsible for everything that happens on your account.

When you create an account you must provide accurate information and keep it current. Do not impersonate another person or create an account on behalf of someone else without their permission.

You are responsible for keeping your login credentials confidential. You are also responsible for all activity that occurs under your account, whether or not you authorized it. If you believe your account has been compromised, contact us immediately at support@carverjs.dev.

Each account is for one natural person. Sharing an account with others, or creating multiple accounts to evade restrictions, is not permitted.

We may suspend or terminate accounts under the enforcement ladder described in the content policy.

acceptable use

in short: use the platform lawfully, do not abuse the infrastructure or other players, and follow the Content Policy for the full list of rules.

You agree not to use the platform in any way that violates applicable law or regulation in India or your own jurisdiction.

You also agree not to:

  • probe, scan, or test the vulnerability of the platform or any related systems without written permission;
  • scrape or harvest data from the platform at a scale that places unreasonable load on our infrastructure;
  • use automated tools, scripts, or bots to interact with the platform in ways that were not designed for automated access;
  • interfere with or disrupt other users' game sessions or the multiplayer infrastructure.

The content policy contains the complete list of prohibited conduct. Violating the Content Policy is a violation of these terms.

your games and your content

in short: you keep full copyright of everything you publish. You grant us a license to host and distribute it on the platform. Unpublishing stops new distribution, but backup copies may persist for a reasonable period.

You own your content. Publishing a game or any other material on the platform does not transfer your copyright or any other intellectual-property rights to us. You retain full ownership of everything you upload.

License you grant us. By publishing content on the platform, you grant MoneyTales EduTech Private Limited a perpetual, worldwide, non-exclusive, royalty-free license to host, store, display, distribute, and promote that content on and in connection with the platform. This includes the right to generate or display thumbnails and screenshots of your game in platform marketing materials that promote the platform generally (not to sell your game independently of your account). We may grant technical sublicenses to the third parties who help us operate the platform (content delivery networks, backup providers, caching services).

Unpublishing. If you remove or unpublish content, we will stop making it available to new users. Copies that already exist in backups, CDN caches, or promotional materials may persist for a reasonable technical period necessary to complete those processes.

Ownership warranty. You represent that you own or have all rights necessary to publish the content you upload, and that your content does not infringe any third-party intellectual property rights.

Feedback. If you send us ideas, bug reports, suggestions, or other feedback about the platform, we may use that feedback for any purpose without restriction or compensation to you.

our stuff

in short: the CarverJS name, logo, site design, and site code are ours. The CarverJS engine is open source under MIT on GitHub.

The CarverJS name and wordmark, the carverjs.dev logo, the visual design of the site, and the site's own source code are owned by or licensed to MoneyTales EduTech Private Limited. Nothing in these terms grants you a right to use them.

The CarverJS game engine itself is a separate, open-source project published under the MIT License on GitHub. That license, not these terms, governs your use of the engine. These terms apply to the marketplace platform at carverjs.dev, not to the open-source engine repository.

beta, availability, and changes

in short: the marketplace is in active development. Features may change or disappear. We make no uptime promises, but we will give reasonable notice before discontinuing the service.

The CarverJS Marketplace is in active development. We are continuously building, testing, and revising features. As a result:

  • features may change, break, or be removed without notice;
  • we make no promise of a specific level of uptime or availability;
  • we may introduce new features that are themselves in beta and subject to further change.

If we decide to discontinue the platform entirely, we will give reasonable advance notice so that creators can retrieve their content.

disclaimers and liability

in short: the service is provided as-is. To the extent permitted by Indian law, our total liability to you is capped at what you paid us in the last 12 months or INR 1,000, whichever is greater.

The platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by applicable law, our total cumulative liability to you for any claims arising out of or relating to these terms or the platform is limited to the greater of: (a) the total amount you paid to us in the 12 months immediately preceding the claim, or (b) INR 1,000.

We are not liable for indirect, incidental, special, consequential, or punitive damages, even if we have been advised of the possibility of such damages.

indemnity

in short: if your published content causes us to be sued over intellectual property or your violation of these terms, you cover the costs.

You agree to indemnify, defend, and hold harmless MoneyTales EduTech Private Limited, its directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

  • any claim that your published content infringes a third party's intellectual-property rights;
  • your breach of any provision of these terms;
  • your violation of any applicable law in connection with your use of the platform.

termination

in short: you can delete your account anytime. We can suspend or terminate for breach. Sections covering the content license, liability, and disputes survive termination.

By you. You may stop using the platform and request deletion of your account at any time through the account settings page.

By us. We may suspend or terminate your access, with or without notice, for breach of these terms or the content policy, following the enforcement ladder described in that policy where circumstances permit.

Survival. On termination, sections that by their nature should survive will continue to apply, including: the license granted for content that was published and not yet removed before termination (section 5), the disclaimers and liability cap (section 9), indemnity (section 10), and disputes and governing law (section 12).

disputes and governing law

in short: contact us first and give us 30 days to resolve the issue. Indian law governs. Courts in Ahmedabad, Gujarat have exclusive jurisdiction.

Before initiating any formal legal proceeding, you agree to contact us at support@carverjs.dev and give us 30 days to attempt resolution in good faith.

These terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. The courts located in Ahmedabad, Gujarat, India will have exclusive jurisdiction over any dispute that cannot be resolved informally.

changes to these terms

in short: we announce material changes on the site. Continued use after the effective date counts as acceptance. Each version is identified by version number on this page.

We may update these terms from time to time. For material changes (those that alter your rights or obligations) we will post a notice on the platform ahead of the effective date. For minor clarifications we will update the version number and date in the page header.

Continuing to use the platform after the effective date of updated terms constitutes your acceptance of those terms.

Each revision is identified by the version number shown at the top of this page (currently v1.0). We keep prior versions available by version number for reference.
